These Terms of Service and User Agreement (the “Agreement”) govern access to and use of the website, services, pages, features, accounts, user data, communities, and any related materials of the BADDANCER project (the “Project”, “Service”, “BADDANCER”, “we”, “us”, or “our”).

BADDANCER is an independent, non-commercial fan project created for informational, reference, entertainment, and testing purposes.

By using the Service, creating an account, accessing the website, submitting data, posting materials, making a donation, or otherwise interacting with the Project, you confirm that you have read, understood, and accepted this Agreement.

If you do not agree with any part of this Agreement, you must immediately stop using the Service.

1. Fan Project Status and No Affiliation with Bethesda / ZeniMax

BADDANCER is an independent, non-commercial fan project and is not affiliated with, endorsed by, sponsored by, approved by, or connected in any way with Bethesda Game Studios, Bethesda Softworks, ZeniMax Media Inc., Microsoft Corporation, or any of their affiliates.

The Project is not an official website, service, product, application, tool, partner, representative, contractor, or commercial offering of Bethesda, ZeniMax, Microsoft, or any company associated with them.

All rights to Fallout 76, Fallout, trademarks, logos, characters, game images, game data, game mechanics, in-game items, in-game names, lore, visual elements, and related intellectual property belong to their respective legal owners, including Bethesda Game Studios, Bethesda Softworks, ZeniMax Media Inc., Microsoft Corporation, and/or other rights holders.

Any references to Fallout 76, Fallout, Bethesda, ZeniMax, Microsoft, in-game items, characters, locations, mechanics, names, images, or other related materials are used solely for reference, fan, informational, educational, or entertainment purposes.

Such references do not imply endorsement, sponsorship, partnership, license, support, affiliation, or any other relationship between BADDANCER and the relevant rights holders.

The Project administration does not claim or imply ownership of Fallout 76, Fallout, Bethesda, ZeniMax, Microsoft, or any intellectual property associated with them.

2. Non-Commercial Nature of the Project

BADDANCER is created and maintained as a non-commercial fan project.

The Project does not sell access to Fallout 76, does not sell in-game items, does not sell in-game currency, does not sell official Bethesda/ZeniMax/Microsoft materials, does not provide official game services, and does not act as an intermediary between users and the rights holders of Fallout 76.

Any website features, reference materials, descriptions, tables, user data, interfaces, or tools provided by BADDANCER are not official Fallout 76 services and do not replace official websites, applications, rules, support channels, or materials provided by Bethesda/ZeniMax/Microsoft.

3. Project Status

BADDANCER is a test, experimental, and demonstration project.

The Service may be in development, testing, prototyping, technical review, closed beta, or open beta. Certain features may work incorrectly, become unstable, be changed, disabled, moved, removed, or replaced without prior notice.

The website and certain Project materials may be created, modified, or supplemented using artificial intelligence tools, automated systems, generative models, scripts, templates, and other technical means.

4. “As Is” and “As Available” Disclaimer

The Service is provided on an “as is” and “as available” basis.

The administration provides no express or implied warranties, including, but not limited to, warranties that:

the Service will be stable, uninterrupted, secure, or error-free;
accounts, progress, statistics, ratings, records, messages, files, settings, or any other data will be preserved;
the information displayed in the Service will be accurate, complete, current, or reliable;
the Service will meet the expectations, goals, or requirements of any particular user;
the Service will be free of errors, vulnerabilities, failures, data loss, technical limitations, or incompatibilities;
any information in the Service will match official Bethesda/ZeniMax/Microsoft data;
access to any features, materials, or data will remain available.

You use the Service entirely at your own risk.

5. Administration’s Right to Block, Restrict, and Delete

The administration reserves the right, at any time, for any reason or for no stated reason, at its sole discretion, to:

block any user;
temporarily or permanently restrict access to the Service;
delete, freeze, hide, disable, or modify any account;
delete, hide, modify, move, or restrict any user content;
restrict access to specific features, sections, communities, pages, or functionality;
reset progress, ratings, statistics, achievements, in-game or other indicators;
prohibit re-registration or further use of the Service;
delete or modify any data that the administration considers inaccurate, harmful, disputed, outdated, infringing, or undesirable for the Project.

The administration is not required to provide prior notice, explain the reason for a restriction, provide evidence, enter into correspondence, review appeals, or restore access.

This right may be exercised to protect the Project, the administration, infrastructure, other users, the community, technical stability, reputation, security, third-party rights, and any other interests of the Project.

6. No Guarantee of Data or Progress Preservation

You understand and agree that any data within the Service may, at any time, be:

changed;
deleted;
damaged;
lost;
moved;
published as part of the Service’s functionality;
hidden;
reset;
wiped;
replaced;
used for testing;
temporarily or permanently unavailable.

The Project database may be fully or partially reset, cleared, modified, restored from a backup, migrated, or deleted at any time without prior notice.

The administration does not guarantee that any data, account, progress, action history, messages, posts, settings, or any other information can be restored.

7. Data Sources and Accuracy of Information

The Service may contain information related to Fallout 76, including reference data, descriptions, categories, names, parameters, user notes, collections, lists, tables, translations, comments, images, statistics, or other materials.

Such information may be obtained from public sources, user submissions, manual processing, original descriptions written by the administration, fan observations, technical testing, artificial intelligence tools, or other sources.

The administration does not guarantee that any data is official, complete, current, accurate, verified, suitable for a particular purpose, or consistent with the current version of Fallout 76.

Any game names, descriptions, parameters, images, or related information may be changed by the rights holders of Fallout 76 without notice to BADDANCER.

The administration may change, delete, correct, publish, hide, move, supplement, or reset any Service data at its sole discretion.

8. User Content

“User content” means any materials that a user uploads, submits, posts, enters, transmits, or otherwise makes available through the Service, including, but not limited to:

text;
nicknames;
images;
avatars;
comments;
messages;
links;
files;
game-related data;
profiles;
descriptions;
statistics;
any other materials.

You confirm that you have all necessary rights to submit such content and that your content does not violate third-party rights, applicable law, platform rules, moral standards, security requirements, or the interests of the Project.

The administration may, without prior notice, moderate, hide, delete, modify, move, publish, restrict, archive, or otherwise process user content for the purposes of operating, protecting, developing, demonstrating, testing, or promoting the Project.

By submitting content to the Service, you grant the administration a non-exclusive, worldwide, royalty-free permission to use, store, copy, display, publish, transmit, modify, adapt, moderate, and technically process such content for the purposes of operating, administering, protecting, developing, testing, and promoting the Project.

You are solely responsible for the content you submit.

9. Prohibited Conduct

Users are prohibited from:

disrupting the operation of the Service, website, servers, database, API, bots, integrations, or infrastructure;
attempting to gain unauthorized access to accounts, data, administration panels, or technical systems;
exploiting bugs, vulnerabilities, exploits, automation, manipulation, spam, bots, or other unfair methods;
impersonating other persons, the administration, partners, Bethesda, ZeniMax, Microsoft, or representatives of the Fallout 76 rights holders;
posting illegal, harmful, abusive, fraudulent, discriminatory, threatening, pornographic, extremist, or otherwise unacceptable content;
violating intellectual property rights, privacy, honor, dignity, or lawful interests of third parties;
using Fallout 76, Bethesda, ZeniMax, Microsoft, or other third-party materials in a way that violates their rights or creates a false impression of official affiliation;
using the Service for fraud, pressure, harassment, threats, circumvention of restrictions, data collection, or other harmful activity;
bypassing bans, restrictions, technical protection measures, or administration decisions;
using the Service in any manner that the administration considers harmful, undesirable, dangerous, unfair, or inconsistent with the interests of the Project.

Violation of any of these rules may result in immediate blocking, account deletion, access restriction, data deletion, or other measures at the administration’s discretion.

10. Donations and Voluntary Contributions

Any financial transfers made by users to the Project, including, but not limited to, transfers through crypto wallets, Boosty, Patreon, DonationAlerts, Buy Me a Coffee, bank transfers, payment forms, subscription platforms, or any other third-party services, are solely voluntary contributions (“donations”) intended to support the independent, non-commercial BADDANCER fan project, including its development, hosting, servers, domain, technical infrastructure, testing, and maintenance.

Donations:

are not purchases of goods, services, digital items, subscriptions, rights, privileges, guarantees, access, or obligations;
are not payments for access to Fallout 76, in-game items, in-game currency, official Bethesda/ZeniMax/Microsoft materials, or any content owned by the relevant rights holders;
do not require the administration to provide any features, bonuses, status, benefits, compensation, or rewards;
do not guarantee preservation of any account, data, progress, access, or content;
do not limit the administration’s right to block, delete, restrict, or modify a user’s account or access;
are final and non-refundable, unless expressly stated otherwise by the administration or required by mandatory applicable law.

The administration is not responsible for the operation of third-party payment services, including fees, delays, errors, blocks, refunds, currency conversion, failures, restrictions, sanctions checks, loss of access to payment platform accounts, or any other actions of third parties.

You are solely responsible for the accuracy of payment details, the legality of the transfer, tax consequences, fees, and compliance with the rules of the payment platform you choose to use.

11. Third-Party Services and Links

The Service may contain links, integrations, widgets, payment forms, social networks, bots, APIs, hosting, analytics tools, feedback forms, and other third-party elements.

The administration does not control and is not responsible for:

the availability of third-party services;
their rules, fees, restrictions, or privacy policies;
actions or omissions of third parties;
loss of data, funds, or access on third-party platforms;
technical failures, blocks, errors, delays, or changes to third-party services.

Use of third-party services is entirely at your own risk.

12. Personal Data and Technical Information

As part of operating the Service, the administration may receive and process technical and user information necessary for the functioning, protection, diagnostics, analytics, moderation, and development of the Project.

Such information may include, for example:

email address;
nickname;
account identifiers;
IP address;
technical logs;
information about actions within the Service;
messages and content submitted by the user;
browser, device, session, and connection data;
any other information that the user provides voluntarily or that is technically necessary for the Service to operate.

The administration may store, change, delete, transfer, back up, and technically process such data as part of the operation of the Project.

You understand that, due to the test status of the Service, data may be lost, damaged, accidentally deleted, changed, or become unavailable.

Where applicable, the processing of personal data must comply with mandatory requirements of applicable law. This Agreement does not waive or limit any user rights that cannot be waived or limited by contract.

13. Publication and Demonstration of Materials

The administration may use anonymized materials, publicly available materials, or materials submitted by users, including data, nicknames, game-related indicators, screenshots of the BADDANCER interface, interface fragments, statistics, and other content, for:

demonstrating the Project;
publications on the website;
publications on social media;
development updates;
advertising and promotion of BADDANCER;
testing;
debugging;
analytics;
documentation;
protecting the Project and the community.

If you post content in public or semi-public areas of the Service, you understand that such content may be visible to other users, published, quoted, saved, indexed, copied, or distributed by third parties.

This section does not transfer to the administration any rights to intellectual property owned by Bethesda, ZeniMax, Microsoft, or any other third party.

14. Modification, Suspension, and Termination of the Service

The administration may, at any time and without prior notice:

modify the Service;
disable specific features;
change the rules;
close registration;
delete accounts;
reset the database;
migrate the Project to another platform;
restrict access by region, user, device, or other criteria;
suspend operation of the website;
permanently shut down the Project.

To the maximum extent permitted by applicable law, the administration is not responsible for any losses, inconvenience, data loss, loss of access, loss of expectations, loss of progress, or any other consequences related to modification, restriction, migration, failure, suspension, or termination of the Service.

15. Intellectual Property

Rights to the original elements of BADDANCER created by the Project administration, including original texts, descriptions, website structure, layout, individual graphic elements, interface design, user-created collections, original reference materials, code, the database as a technical structure, and other original BADDANCER materials belong to the Project administration or are used by it on a lawful basis, unless otherwise stated.

At the same time, the administration does not claim ownership of Fallout 76, Fallout, Bethesda, ZeniMax, Microsoft, official game materials, trademarks, logos, characters, game images, in-game items, game data, lore, visual elements, or any other intellectual property owned by third parties.

All rights to such materials remain with their respective legal owners.

Users receive a limited, revocable, non-transferable right to use the Service solely for personal, non-commercial purposes and only within the limits permitted by the administration.

You may not copy, reproduce, distribute, sell, modify, decompile, commercially exploit, or otherwise use original BADDANCER materials without the administration’s written permission, unless such use is permitted by law.

You may not use third-party materials, including materials related to Fallout 76, Bethesda, ZeniMax, Microsoft, or other rights holders, in any manner that violates their rights, rules, licenses, or applicable law.

16. Limitation of Liability

To the maximum extent permitted by applicable law, the administration is not liable for any direct, indirect, incidental, special, punitive, consequential, or other damages, including, but not limited to:

loss of data;
loss of account;
loss of progress;
loss of access;
technical failures;
errors in data;
inaccurate reference information;
actions of other users;
actions of third parties;
claims related to materials posted by users;
payment service failures;
inability to use the Service;
user expectations regarding the operation of the Project;
any consequences of blocking, deletion, restriction, or modification of an account.

Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under mandatory provisions of applicable law.

17. Rights Holder Claims

If a rights holder believes that any material on BADDANCER infringes their rights, they may contact the administration at: [email protected].

The notice should preferably include:

the specific material alleged to infringe rights;
a link to the relevant page or a description of where the material is located;
confirmation of the claimant’s rights or authority;
contact details for correspondence;
the requested action: removal, modification, hiding, or attribution clarification.

The administration may, at its sole discretion, remove, hide, modify, restrict, or temporarily disable disputed material without admitting any infringement and without prior notice to users.

18. No Obligation to Provide Support

The administration is not required to provide technical support, respond to inquiries, review complaints, restore accounts, return data, explain moderation actions, enter into correspondence, or ensure constant availability of communication channels.

Any response from the administration is voluntary and does not create any obligation to provide support in the future.

19. Changes to this Agreement

The administration may change this Agreement at any time without prior notice.

A new version becomes effective upon publication on the website, unless otherwise stated in that version. Continued use of the Service after a new version is published constitutes acceptance of the updated terms.

Users are solely responsible for periodically reviewing the current version of this Agreement.

20. Transfer of Rights and Project Management

The administration may transfer, assign, sell, migrate, delegate, or otherwise transfer rights to original BADDANCER elements, obligations, infrastructure, domains, data, accounts, original materials, code, databases as technical structures, communities, payment details, and other Project elements to third parties, partners, contractors, new owners, or new administrators, where such transfer is related to the operation, development, sale, migration, reorganization, support, or termination of the Project.

This section does not and cannot transfer any rights to Fallout 76, Fallout, Bethesda, ZeniMax, Microsoft, or any third-party intellectual property that the BADDANCER administration does not own.

Users may not assign or transfer their rights or obligations under this Agreement without the administration’s consent.

21. Severability

If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, this does not affect the validity or enforceability of the remaining provisions.

The invalid provision shall be interpreted or replaced in a manner that preserves the original meaning and purpose of this Agreement to the maximum extent permitted by applicable law.

22. Applicable Law and Disputes

This Agreement applies to the extent that it does not conflict with mandatory provisions of applicable law.

Until a specific Project jurisdiction is determined, any disputes, claims, or inquiries should, where possible, be addressed directly to the administration at: [email protected].

The administration may independently determine, change, or clarify the applicable law, dispute resolution procedure, and contact details in future versions of this Agreement.

23. Final Provisions

This Agreement sets out the main rules for using the BADDANCER Project.

By using the Service, you confirm that you:

understand the fan-made, independent, unofficial, non-commercial, test, and experimental nature of the Project;
understand that BADDANCER is not affiliated with Bethesda, ZeniMax, Microsoft, or official Fallout 76 services;
understand that all rights to Fallout 76 and related materials belong to their respective legal owners;
accept the risk of losing data, progress, access, and content;
agree that the administration may restrict, delete, modify, and block accounts and materials;
understand that donations are voluntary and non-refundable;
understand that donations are not payments for Fallout 76, in-game items, official content, or services of the rights holders;
use the Service voluntarily and at your own risk.

If you do not agree with these terms, you must stop using the Service.
